Our general terms and conditions of sale exclude any conflicting purchase clauses that any client might invoke. The GTCS specifically provide for the acceptance of the processing of personal information relating to buyers by Pupa Biasucci. Personal information relating to buyers is protected in accordance with the law, and is not transferred, resold, or loaned to third parties. The contact details and personal information collected via our email list are used exclusively for order processing. Information regarding paper types, dimensions, and colors is provided for informational purposes and may vary from one production to another. Do not hesitate to contact us for more details.
Prices: Our prices are ex-works. The prices listed in the catalog include all taxes; any order is honored at the price validated when the order is placed by the customer. Catalog prices are subject to change without notice.
"Reseller and Professional" Prices: Our prices are ex-works. Resellers benefit from a special price; special reseller conditions are only applicable to products defined in the reseller range. Professionals benefit from special conditions.
Payment: Orders are payable in cash via bank transfer to the account BE 69 3630 8128 9878 at the time of order placement. Each order is invoiced.
Transaction Confidentiality Clause: Transactions made for the brand Olala by Pupa will be processed securely and confidentially, in accordance with current security standards.
Acceptance of the GTCS: Placing an order implies acceptance of these general terms and conditions of sale. Any potential client purchase agreements are not enforceable against Pupa Biasucci's general terms and conditions of sale unless expressly accepted in writing by Pupa Biasucci.
Order Fulfillment: Products are available for sale for an indefinite period. Pupa Biasucci reserves the right to modify certain technical characteristics without notice. The products presented do not constitute a legal offer but a non-contractual catalog whose prices and specifications may change at any time. To be valid, an order must be fully paid in advance by bank transfer. The buyer must send an email to pupadesign.info@gmail.com to inform the seller of their purchase. The buyer must provide their contact details/billing and shipping address, email, and phone number. Each order is subject to confirmation by the seller; the order is deemed accepted only upon receipt of this confirmation email.
Delivery Times: Delivery times are provided for informational purposes and are not contractual commitments.
Force Majeure Clause: Pupa Biasucci will not be liable for delays or failures in the performance of its obligations under the contract for the Olala by Pupa brand caused by events beyond its reasonable control.
Shipping Cost: Given the daily changes in transport offers from our partners, this table is subject to change without notice. As such, it is only indicative and does not have any contractual value or commitment. In case of a discrepancy with a price quoted in an estimate or order, the price of the estimate or order prevails.
Damaged Goods: Each order is carefully checked and packaged. Upon receipt, please check the condition of the package; if it is damaged, refuse the package. If the condition of the package is acceptable, please systematically note "subject to unpacking." You have 3 days from the date of delivery (or 21 days for international shipments) to send us your complaint, which is valid if you follow the above steps.
Delivery and Export: Damaged product, missing product with open package: Orders travel at the recipient's risk. Delivery providers consider their responsibility to end once the goods are received by the customer or their duly authorized representative. To hold the carrier liable, you must make reservations on the delivery slip. Be vigilant when receiving your order.
For deliveries outside the European Union and the overseas departments and territories, and in accordance with the tax and customs law of each country, any taxes specific to your country or territory (customs duties, local VAT, customs or import taxes) may be charged at the time of delivery by the carrier, who then pays them to the authorities. These duties and taxes are entirely the responsibility of the recipient; they are taxes, and their payment is mandatory.
Pupa Biasucci cannot be held liable for the payment of these taxes on behalf of the client. Note: Even in case of refusal of payment or refusal of the package by the client, the duties and taxes remain due by the client regardless. In case of non-payment to the carrier, the taxes and duties will be deducted from the amount of the returned package's merchandise, plus all surcharges and administrative fees required by customs and the carrier.
Undelivered Order: If you wish to dispute a delivery, we can hold the delivery service responsible with a file: send a request explaining the facts, the invoice, a sworn statement indicating "that the order was not received contrary to what the delivery provider indicates," and a police report.
Retention of Title: The products remain our property until full payment.
Plagiarism: The client acknowledges that all designs created by Ms. Biasucci are protected against plagiarism and agrees not to reproduce, copy, or use them for commercial purposes without prior written authorization from Pupa. Any violation of this clause will result in legal action for intellectual property infringement.
Cancellation: Order cancellation before shipment is impossible.
Returns: Our wallpapers are custom-made products: Custom-made products, especially wallpaper strips, are manufactured to order (within the constraints of production), which prevents any return of these products.
Warranties and Claims: Products sold by Pupa Biasucci come with a 3-month warranty against potential defects. However, papers, colors, chemicals, and other materials used in our productions may slightly alter over time, particularly due to UV radiation, significant temperature variations, or excess humidity. There may also be occasional shade variations from one production batch to another; in these cases, there is no right to replacement of any kind. In case of a claim, the client must send an email to biasuccipupa@gmail.com, attaching all relevant documents (photo of the product, copy of the delivery note, etc.). Claims to the carrier are made by the seller. Pupa Biasucci will take great care of your claim and will respond as soon as possible. Claims for visible defects must be made within eight days of receiving the products by the final customer.
All claims must be made by email (biasuccipupa@gmail.com). This email must include all relevant information that can help us process your request as quickly as possible (order/invoice number) and explanations of the problem encountered. If your claim concerns wallpaper, you must send us a sample of the wall covering or, failing that, photos that allow us to understand the problem. Telephone claims cannot be considered without being supplemented by an email to customer service as indicated above. Without a complete file, the claim will unfortunately be considered inadmissible. Wallpaper must be checked by you or the installer you have appointed to carry out the work before implementation. If you notice a defect on the delivered product, you must notify us immediately and not start the implementation or stop it as soon as the problem is detected. If there is an apparent defect on a delivered product and it is implemented anyway, your responsibility is engaged. To be taken into account, a claim for a product with an apparent defect must reach us, complete, within 15 days of receiving your order; otherwise, the claim cannot be taken into account. If you notice a defect after installation, it is either a perceptible defect and you implemented it, engaging your responsibility, or it is an issue related to the implementation. Our wallpapers are produced either by digital printing or traditional printing (rotogravure). In both cases, dimensional deformation tolerances are 1.5mm/1000mm. The implementation must respect the practices for non-woven wallpaper, particularly the supplier's instructions for the adhesive you have chosen. Poor implementation engages your responsibility or that of your installer, and Pupa Biasucci cannot accept claims regarding implementation issues.
Examples of poor implementation for wallpaper include: incorrect adhesive dosage, gluing the paper instead of the wall, lack of surface preparation, smoothing with an unsuitable object, improper handling of the paper, inappropriate cleaning—this list is not exhaustive. Pupa Biasucci supplies wallpapers that are semi-finished products; Pupa Biasucci's warranty ends as soon as the implementation is fully or partially completed. If the claim is made in time and if, after verification, a defect is established and it is not attributable to incorrect installation, implementation, or cleaning, misuse, or negligence by the client, Pupa Biasucci, at its discretion, will replace the affected goods free of charge or credit all or part of the invoiced amount for the goods, without Pupa Biasucci being liable for any compensation.
Copyright: All the products offered in our catalog are original works created by Pupa Biasucci or independent artists. In any case, Pupa Biasucci holds the reproduction rights for the works concerned. Any reproduction of works without the rights holder's consent would be a violation of their rights.
Damages: In the event of the implementation of visibly non-compliant products (in terms of quality or references), the client's implementation does not entitle them to any damages. The client or the installation company is responsible for the product's implementation.
Duration and Modification of the GTCS: These GTCS are valid indefinitely. We reserve the right to modify the GTCS at any time and without notice. The general terms and conditions of sale in effect at the time of order placement will apply.
Jurisdiction Clause: The Commercial Court of Liège has sole jurisdiction to handle any disputes arising from an order placed with Pupa Biasucci via email or any more general issue related to the Olala by PUPA brand or claims arising from the rights to the works used in our ranges.
Contract Language Clause: This contract is written in French. If the contract is translated into another language at the client's request, the translated version is provided for informational purposes only.
In case of any discrepancies between the original French version and any translation, the French version will prevail and be considered the only binding version for the interpretation and execution of the contract.
